Parents' Bill of Rights for Data Privacy and Security
The East Rochester School District is committed to protecting the privacy and security of each and every student’s data. Parents should be aware of the following rights they have concerning their child’s data.
NYSED Data Security and Privacy Policy
This policy addresses NYS Education Department’s (the Department or SED) responsibility to adopt appropriate administrative, technical and physical safeguards and controls to protect and maintain the confidentiality, integrity and availability of its data, data systems and information technology resources.
Privacy and Security for Student Data and Teacher and Principal Data
The District is committed to maintaining the privacy and security of student data and teacher and
principal data and will follow all applicable laws and regulations for the handling and storage of this
data in the District and when disclosing or releasing it to others, including, but not limited to, third-party
contractors. The District adopts this policy to implement the requirements of Education Law Section
2-d and its implementing regulations, as well as to align the District's data privacy and security practices
with the National Institute for Standards and Technology Framework for Improving Critical
Infrastructure Cybersecurity (Version 1.1).
Student Directory Information
In accordance with The Family Educational Rights and Privacy Act (FERPA), the District limits
the disclosure of directory information (to individuals other than those with legitimate educational
interest) to specific parties, for specific purposes, as set forth below and in its annual notification to
parents/eligible students.
Student Privacy, Parental Access to Information and Administration of Certain Physical Exams
The Protection of Pupil Rights Amendment (PPRA, 20 USC Section 1232h) affords parents
(including legal guardians or other persons standing in loco parentis) certain rights regarding the District's
conduct of surveys, collection and use of information for marketing purposes, and certain physical exams.
The District has developed and adopted this Policy in consultation with parents/guardians.
